My husband filed restitution of conjugal rights

08-May-2024 (In Divorce Law)
I have left my husband after one year of marriage and filed dvc case against him and his parents. After 2 years of filing my dvc case, my husband filed restitution of conjugal rights. Right now I'm residing in US and not attending court hearings. Will it be an advantage to my husband. Should I have to compulsory attend court for this restitution of conjugal rights. Can I prolong my dvc case for another 1 year without attending court hearings

Please be informed that it is advisable to attend the court hearings for restitution of conjugal rights. If you want to be in the US, then you can send us your signed Vakalatnama to attend your case here and ur hearings can be arranged through VC and we can take care of the case. For further queries, do let me know Regards

Hi Maam, In case you can’t appear, please appear through an advocate so that the case doesn’t go against you and you are there to defend the case. Your advocate could also take permission for a VC, and when you physical presence is required, you can schedule the same. Please feel free to reach out to us for a better discussion and assistance on this issue.

It’s not mandatory to come and attend the hearings in person. You can give your Special Power of Attorney to any family member who can attend the court dates on your behalf. Yes, you can prolong your case for sometime.

Since you are residing in US, you should give power of attorney to someone else maybe your parents. Your lawyer can present himself in the court on your behalf. You don’t need to attend the hearings physically. If necessary, the court can call for video conferencing.
