If your husband is not ready for divorce you may file it on the other grounds available but you need to have some valid grounds to proceed with it. If the cruelty has been perpetrated of any kind then it may become a ground for filing a divorce petition and even if the violence of any kind has ever been committed during the stay in the matrimonial home

If he is not agree then obviously you have to file your divorce on the ground of cruelity before the court of law and also proceed with the same. You have to make a ground for your divorce petition before tbe court

At first send a legal notice to the husband seek for mutual consent divorce as it is fastest way to part away. If that fails then u may apply for divorce on the grounds of cruelty and legally seek maintainence

File divorce case on ground of mental cuelty and torture.
It would be a solid ground of divorce.
If your husband does not pay money for your basic needs it will be also a solid ground for maintenance
