How do I divorce wife who never had sex with husband and satisfy

Hi sir, june 6 2016 got married and she left in the middle of road on oct 02 2016 by saying not able live anymore with the family and you. she never have sex from the date of marriage. we stayed together in their house for 10days and honeymoon for 7day. and in our house around 40days. she had never tried to come closer to me from the date of marriage. so i failed null the marriage. after-that we have counseling for 3times. in which she had agreed that she does not had sex by giving reason shy, not feeling well, family have quarrel etc. and she asked for her siddanas. After counselling is finished she does not file counter. instead of she filed section 25 to get back her sidanas by stating the our family forced her to leave house. and we are giving baseless reasons. we are having doubt that after giving the sidanas she will file against our family by stating false reason. kindly advise us what to do now.

Hello,

You may file a mutual divorce where you both will get settle without any issues.

On mutual further there will be no cases where you both sign memorandum of understanding that there will be no further deal between you and her

According to your statement you have filed a petition for null and void. And she has filed a petition under section 25 of Hindu marriage act.
You have filed the petition to declare your marriage as null and void. Which is correct. You return her Shridhana articles and make an endorsement in the court and try to finish off the case soon n get the divorce. Stress your lawyer to proceed and stress to finish the case soon

It seems that, your marriage is not consummated, as per your words you got separated from your wife from Oct 2016 after completion of one year from the date of such separation you can very well approach the court concerned to obtain divorce or else if you want to have a reunion with your wife, then you have to approach a lawyer and get advice from him to initiate proceedings for restitution of conjugal rights. The option is yours. Either you can ask your wife to come for reunion or you can obtain divorce.

Sir,
If the sridhana articles are returned inthe presence of the court she cannot agitate again for for return of any property but she can file a complaint against you and your family members for demand of dowry. It is better you get a written undertaking from her.
