Brother's wife filed false case in women cell and left hope on her own

Sometime back my cousin's wife leave the house without consulting parents under the reason of their views are not matching and they are not satisfied with each other and she wants to get immediately divorce under the circumstances. She took all her belongings and ask to meet her lawyer. we have asked her to send a draft of the divorce petition for our consideration. However, they did not send any such document but a day before yesterday there was a phone call from women police station asking us to go through an application made by her giving another family name as well. Now our question is after 1 1/2 month period, how she file an application to women police cell rather than local police station? what are the consequences of this? What action we take against such petition.

Hi,

She can file the complaint in the women cell.
First the complaint need to be filled at women cell then they will call both the parties and try to get the matter settled, if its not settled they will send the case to the local police station so that FIR is registered.
Its up to her whether she want to take divorce mutually or not you cannot force her .

Under the given circumstances she can file a complaint before Mahila Police Station even after reasonable period has elapsed. in your case, the period of one and half month is not unreasonable. moreover, nowadays the local police does not register the FIR immediately they refer the complainant to Mahila Police Station. the procedure at Mahila Police Station is different than regular police station, here they first take the written complaint and ask the respondents / accused to come for reconciliation. they dont arrest or harass the husband or relative of husband, however they first tries to resolve the dispute between the parties. But they found that husband side is at fault then only they lodge the FIR and if they found that woman is making unnecessary compliants, they used to dismiss the complaint. thereafter my advice to you, is to attend the Mahila Police Station and try to resolve the dispute at their level only.

women cell is institution for women. So may be she filed application for harrsment.
So dear u have to visit and give written rply agaist what ever allegation made by her.
And if she wants divorce than go for further process on same

period of 1 1/2 month is not of that importance in such matrimonial disputes. she has approached women cell who has powers to investigate such matters. you need not worry. police will not arrest you immediately as per recent supreme court guidelines. i would suggest you to go there and try to bring an amicable solution for all the times to come
