What is the procedure to take a case back filed earlier

Hi I wanted to know exactly how many days and how much money would be required to get the person out of jail,convicted under ipc 379/411 . Brief about the case: A phone was taken away from office because of utter frustration and anger of seviour salary pain as not paid for more than two months.However the accused returned the phone on next day by himself while self realizing that it was not the right thing/shameful act because others property. Though the phone owner accepted appology as colleague at work, but Police got involved and FIR /case filed under 379/411 ipc and sent to jail. So please be advised as how this case could be closed before chargesheet filed.and if possible ,be advised how much fee would be required(maximum) to finish the case.Please be reasonable

You cant take back the case however you can give evidence in the favour of accused by saying phone was not stolen, or accused also has similar fone etc. So he will be proved non guilty by court. getting case closed before chargesheet u hav to xplain all this to IO. Contact for further help

In reply to your query I would like to suggest you the fee and expenses comes with person to person and case to case and time required for the same also depends upon nature of offence and gravity of the offence.

The punishment for both 379 and 411 is less than 7 years and as per law of the land a person cannot be arrested before filling of chargsheet. However, if the person has been arrested you can file a bail application before the session judge and if your bail application is rejected then you may approach High Court. Also it is advised that you file a discharge application after you get the bail.

As 379 & 411 both are compoundable offence but case could not be close before charge sheet as soon as they will charge sheeted you should give application to compromise so on first and second hearing case will be close.why they didn't get bail ?

There are two methods by which this case can be terminated. The first by means of Section 320 of CrPC and the Second by means of Section 482 of CrPC. The 1st procees will be successful only if the value of the property is less than 2000.
