Sir, A person falsely filed a criminal case against me. The witnesses he made said they have not known the incident. But the Police have falsely written a chargesheet against me. Q: how to get bail in section 354 ipc , a,c,d, 504 and 506?

what is the further procedure for ipc 354, 354a ipc,c,d, 504 and 506 after filling chargesheet in court? A police person who handling this case ask me to get bail in same day of all persons who involve in case. What is the procedure to get bail and what document or amount we have to deposit or submit in court? is 354d ipc bailable or not ?

You need to file application in chief judicial magistrate court first if that rejected then in session and after that in the high court, as far as the the security is concerned it will be fixed by the court looking various aspects of the case.



Q: what to do if bail is rejected in sessions court ?

My friend has been charged with sec 379, 420, 467, 468, 471, 65-66 IT act, 3/6 exam in FIR and is presently under 14 days judicial custody. His bail application for consideration before session court Allahabad is due shortly. Many are suggesting that getting bail at session court is very dim. In case his bail application is rejected, what will be better course of action either to move high court or tendering fresh bail application in session court. what to do if anticipatory bail is rejected by sessions court? How much time it is likely to take and what are the chances that high court will grant bail on aforesaid sections.

In your case if bail is rejected then you should move a bail application before high court, it will take approximately twenty to twenty five days, chances will depend on allegation in the first information report, If allegation is not too serious and there is no better evidence against you then it's a better case for bail, you need to provide all the papers including first information report as well as case diary for better help



Q: can statement under section 164 crpc be recorded twice

There is a rape victim. Her statement under 161 and 164 has been recorded. Non bailable warrant has been issued. Can police again ask for the victim's statement for video recording? Can the victim deny giving statement again and again? can statement under section 161 crpc be recorded twice ?

Yes police can ask for the recording the statement of victim under section 161 Cr.P.C, but in your case statement under section 164 Cr.p.C is recorded as now it's not relevant to record statement under section 161 Cr.p.c, you can deny the same on the basis of statement recorded before chief judicial magistrate under section 164 Cr.p.C, but victim shall be examined at the time of evidence before trial court.
