Due to a fight, a case has been registered under sections 323, 504, and 506, and the police are forcing the complainant to obtain a medical copy from the CMO. However, both parties want to compromise, but the police have not accepted this for more than a week and are now asking for a bribe. What steps can we take to file a compromise petition under CrPC, and how to compromise a criminal case?

Respected Sir, you can file a petition under Section 482 of CrPC seeking quashing of all the proceedings arising out of the FIR if the offences are not compoundable under section 320 of CrPC. You ll have to file the compromise deed along with the petition.



Q: what to do if bail is rejected in sessions court ?

My friend has been charged with sec 379, 420, 467, 468, 471, 65-66 IT act, 3/6 exam in FIR and is presently under 14 days judicial custody. His bail application for consideration before session court Allahabad is due shortly. Many are suggesting that getting bail at session court is very dim. In case his bail application is rejected, what will be better course of action either to move high court or tendering fresh bail application in session court. what to do if anticipatory bail is rejected by sessions court? How much time it is likely to take and what are the chances that high court will grant bail on aforesaid sections.

The better course of action would be to approach High Court. Since the session court can grant bail upon a subsequent bail application only if there is a changed corcumstances or else you will have to wait for considerable time to file for a subsequent bail application. Therefore best option would be to approach high court.

In order to transfer a matter from one state to another, one can file a transfer petition before the supreme Court. Supreme Court upon considering the same may transfer the matter from one state to another.

Q: My wife died during pendency of divorce, DV, S 24 case

Hello, I am a hindu. My wife has filed several civil and criminal cases in GZB. I have filed divorce. during pendency of all such cases and while staying with her parents for more than 18 mth suddenly i got to know that she died in a reputed private hospital where she was admitted by her parents.No one informed me of her illness or her death. After 11 months of her death her elder sister and jija (both lawyers) have filled complaint u/s 156 (3) against me and my family for registering a FIR u/s 302, and 498a. They have also filed a consumer complaint in National consumer forum against the doctors and hospital for medical negligence and claimed 3 CR. They have filed another complaint u/s 156 (3) against doctors and hospital for criminal conspiracy. The story they are cooking is that I and doctors have grouped together to kill her. Please suggest what should be my defense as i will not get opportunity to present my case in 156(3). My other cases like DV, Divorce, Sec 9 & 24 got dismissed
