Water seepage from the flat above what action can I take

SIR, i am owner of a flat in one residencetial soceity in Gurgoan. The person who is staying in the flat above me is doing some construction due to which severe water seepage is coming down to my flat which is just below his flat. Plus there are also misbehaviour on his part. Repeated request to the said owner to rectify the situation has not been of any result. The issue has been taken up with respective RWA, but of no use. Can u say what legal action i can take to save my flat from further damage. May I request a early reply if possible.

Sir ist of all we have to see whether the construction being done is legally permissible or not if not that a case can be file seeking permanent injunction, if it is permissible even than a case can be filed seeking mandatory injunction directing the flat owner to take proper preventive measure to ensure that no damage is done to your flat and in case any damage is done or whatsoever has been done be repaired to your satisfaction by the said owner or yoh may get it repaired as risk and cost of the owner of flat above your flat. Before filing a case a legal notice be served upon the owner .

Hi dear. You can send a legal notice through an Advocate to that person to take immediate action to repair the seepage, if he denying to the notice then you can file a civil suit for mandatory injunction and recover the amount of loss already you have suffered.
