Membership transfer fee- Karnataka Apt Owner Act

Hi LR Team, I need a clarification, which i couldn't get from the website Blogs/ FAQs. Question is: Is membership transfer fee levied by an Apartment association on buyer of resale apt flat unit legally tenable ? Background: The association is registered under Karnataka Apt Ownership Act, has demanded & collected the Fee, as per registered Bye-law. My understanding is: This charge seems to be a practise borrowed from Cooperative Housing societies, who are required to manage all the title related documentation. In Group Housing societies, this is the responsibility of the Authorities and the Registrar.

You need to pay the fees as per the bye law. There is no regulation on the particular fee to be charged under the Karnataka apartment ownership act. If such fees need to be challenged, you can challenge it during the meeting of the apartment owners association and request for amendments to the bye law.
