how to legally handle civil suit with sbi

have a cc a/c with sbi since 2008 , lmt 2 lacs, suddenly the business went down where i tried to run the same but the debit balance increased, i regularised the a/c two times, but could not maintain it, i wrote them to convert it into emi so that i can pay it on monthly basis, i am having all the written application too. in the mean time they adjusted rs 80000, with my fd security , and asked for the balance. i again wrote them to convert it into emi but they did not responded me and now have filed a civil suit at durgapur court, in my name and my mother who is guarantor, i am having all the acknowledge applications of them . what shall i do now. i am financially weak .

Perused your query. Since you have taken a loan (cc account) you will have to repay it to the bank someday or the other. But since the bank is reluctant to convert the amount due into emi, you can apply to the court for paying the same on emu basis. Please contact for more details.
