Q: Bank claiming their dues from Chidlren of borrower

I was 14 years old when my parents took loan by mortgaging their property. They defaulted and the property was sold at auction, but still my parents owe 50 lakhs rupees to the bank. The bank is not coming to us for recovery for last 6 months now. I am their youngest son, I never signed anywhere as co-applicant for recovering my parent's loan. Will the bank come to me for recovering money in future after my parents' passing away when I have my own property and assets? Am I in danger in anyway?

Advocate Abhishek Dutt answered
The bank has right of recovery on the property that you inherit from your parents and not on your self acquired property. You don’t have any danger on your self acquired property nor are you liable to repay the loan. However the bank can recover the dues by selling the property which you have inherited from your parents

Q: Refund not issued even after multiple intimation.

On March 6th 2023, I placed an order for a 1-ton AC from However, I had to cancel the order on March 8th since it was not processed. Instead, I bought the AC from a local shop. I received an email and SMS confirming the cancellation of the order, and the website also shows that the order is canceled. However, I have not received any refund as of today. Please contact through email.

Advocate Abhishek Dutt answered
You need to address a legal notice to the online portal company for refund of the amount alongwith interest and if they fail to give refund within a specified period you need to file a case in consumer forum to get back your refund alongwith compensation and interest

Q: Inheritance of my father's property

I took a loan against my property. I defaulted and my mortgaged property was sold on auction by bank. The DRT says I still owe 50000 rupees to bank. I could not pay it off. Because I am retired man and do not have much income. My question is, can I inherit my father's property while I still owe to bank? Can bank try to take my ancestral property after inheritance in future? Any reply in details will be helpful.

Advocate Abhishek Dutt answered
Yes you can inherit your father’s property but the bank can recover their claims when you inherit the property from your father. It is better to pay the 50k to the bank and take noc from them. Alternatively ask your father to transfer property to your wife or son and not to you
