How to come out of this civil issue

Hi , My father had ancestor property later that it got divided between both my father and his younger brother.its been 20 yrs now and thot of seling that property ,but now we came to know that it has been purchased by his younger brother wife through court aucton,before getting into partition only,younger brother has cheated to my father,because that property was mortgaged earlier by my father and his younger brother.my father thot it got released before geeting into his name... More over his younger brother is a lawyer,and coverted that property into his wife name in the name of aution,they bought sale certificate from court.we have consulted many advocates and they are telng to file criminal case for his younger brother

You may file both civil and criminal cases against your uncle ( younger brother of your father) . But you have to first obtain the mortgage details of the property. Who had mortgaged the property, when and when partition was done will all be relevant facts.

It appears from your explanation you have to file criminal as well as civil case against your father's brother in law since he deliberately not disclosed that the property which falls in your share is purchased by her wife before partitioned. For better opinion consult me with all documents
