Eviction of shop tenant which is in unregistered time-barred agreement

I have let out one of my shop 1500/ PM under unregistered rental agreement for 3 years on 25/12/2004 duly sign.by the notary. After completion the agreement were not renewed by us.Tenant has made a sublet to his nephew who is paying rent continue.Now I want to vacate the shop on ground of bonafide need & subleted. But my document have invalid due to time-barred and also unregd which will also inadmissible in the court.I am in very confusion. May I serve the notice u/s T.P.106 amendment 2002! Kindly suggest me the right enforceable and suitable notice however to get my premises. Where may be suit filed for eviction RCA or civil court. Notarized original agreement copy given to each other with sign. Tenant has deposited 131000/ as a security advance which is refundable as a without interest. Thanks with regard

you have a remedy of filing eviction petition under cg accomodation control act 2011 before rent control authority.the new act replaces earlier accomodation control act 1961.the new act of 2011 is owner friendly
