28-Apr-2023 (In Civil Law)
Hello Sir, FIR filed by my Girlfriend against me and there are the section imposed 354D,419,420,506,500,509,66D,67A.FIR was lodged 1.5 month back and 1 week earlier i got an interim bail and case is like state vs me. Now i need your response on below query: 1) Can i now lodge a counter FIR against my GF? if yes then till when i can do so,like before submission of charge sheet or can i do so after charge sheet also? 2) Now i am on interim bail but me and my family members are feeling unsafe and having fear of harm from her(GF) family,Can i do something for this like, lodge a FIR stating that if anything happen to me and my family,my GF's family will only be responsible? 3) In case she wants to withdraw the case till what stage of case she can submit her request for case withdrawal? 4) till what stage of case she can submit a withdrawal request so that i can use it for quashing. A quick address of the above query will be much appreciated. Thanks, molu

MY OPINION THAT I have going your present factual position as well as the sections implemented against you in criminal procedure code, my suggestion that you have every scope to challenge through FIR and /or other necessary proceedings against your girl friend at the competent forum /forums.

You can lodge FIR against any one even your Girl Friend also. But remember it that, there is some material of the FIR and you should explain the delay for lodge the FIR if you mention any event against your G.F. just after lodging her FIR which will be treated as Counter FIR as you say. Otherwise, at present time, if your GF or her relative did something against you or your family then immediately file an FIR, this will be treated as FIR not Counter FIR and it will be very good for your Case.
She can withdraw the Case after charge sheet.
You can contact with Advocate practicing in High Court relating to Quashing. Because quashing procedure has triable at High Court only.
