Closing the well between two plots neighbor not cooperating

I got a land from my parents.It is having a old water well which is not working now constructed approx 75 years ago between my plot and my neighbour plot.Once upon a time it is a single plot afterwards my neighbour sold some part of their plot to my parents but at that time they didn't mention about the well in documents.Now I want to construct a house in my land by closing the well which came into my area,but my neighbour not agreeing for closing the well.I do not have any own house that's why I want to construct my house as early as possible.So what I can do now to solve my problem?

If the well is in your property, you don’t need permission from anybody to close the well. If the dispute is about half well in your property and half well in your neighbours property then you have to a file a suite for possession of well. Before that issue a legal notice with your property boundaries to your neighbour explaining your intentions to close the well. Most of the time legal notice will do the job without going to court.
