Hi there, your wife can claim maintenance regardless of the registration of marriage if you both are Hindu or marriage was solemnised in India as per personal laws. Further, she can still claim the maintenance under 125 Crpc regardless of when and where you married if there exists COA in India. If you have any questions please feel free to contact me.

If the marriage is valid as per the personal law applicable to the parties, Indian courts can grant maintenance under Section 125 CrPC, the DV Act and relevant personal laws, irrespective of the fact that the foreign jurisdiction does not recognise alimony. Indian courts are not bound by the foreign country’s concept of maintenance.

Yes, a woman in a live-in relationship resembling marriage can claim maintenance under Sec 125 CrPC and the Domestic Violence Act. A marriage registered abroad where alimony is not recognized is no bar; Indian courts can grant maintenance if Indian law applies.
