The act of that person will not be covered under rape but he can easily be booked under section 75 and section 79 of BNS that is punishment for sexual harassment and outraging the modesty of a woman. For more legal assistance I am just a call away.

agar jaanbujhkar kisi mahila ko sexual intention se touch kiya gaya ho, body rub ki gayi ho, ya outraging modesty/sexual harassment ke facts prove hote hain, to circumstances ke anusar IPC/BNS ke sambandhit provisions lag sakte hain. Har case apne facts, evidence, CCTV, witnesses aur intention ke basis par decide hota hai. Isliye bina poore facts ke kisi specific offence ka nishchit opinion dena sambhav nahi hai.

Not rape as it requires penetration— outraging modesty of women will be applied Section 74 of the Bharatiya Nyaya Sanhita (BNS) (formerly Section 354 of the Indian Penal Code) covers assault or criminal force against a woman to outrage her modesty. It is a cognizable, non-bailable offense punishable by 1 to 5 years in prison and a fine.
