A contested divorce under the Hindu Marriage Act starts by filing a divorce petition in the Family Court on grounds such as cruelty, desertion, adultery or mental harassment. After filing, notice is issued to the opposite party, who files reply and evidence. Mediation/conciliation is usually attempted first. If settlement fails, the matter proceeds for evidence, cross-examination and final arguments. Interim applications for maintenance, child custody and residence rights can also be filed during the case. Time depends on facts, evidence and cooperation of parties.

File a petition in Family Court specifying grounds like cruelty or desertion under the Hindu Marriage Act. The court sends summons to the spouse, records evidence, conducts trials, and passes the final decree.

A contested divorce under the Hindu Marriage Act starts with filing a petition on grounds like cruelty, adultery or willful desertion without any practical and logical/concrete reasons, malafidely not satisfying physical needs of a spouse to unleash mental trauma within her. Court issues notice, evidence is led, witnesses are examined, arguments heard, then judgment is passed.
