If the girl is below 18 years (minor)Under the POCSO Act, 2012:Section 7 – Sexual Assault:If a person touches the private parts (including buttocks) of a minor with sexual intent, it amounts to sexual assault.Section 8 – Punishment:Imprisonment (minimum 3 years) + fine.

Q: Eviction of tenant from joint property by other joint owners

Respected Advocates, A tenant was inducted into a part of a joint property by some of the joint owners. One of the other joint owners wants to evict the tenant on the ground that it is a Joint property and they do not have any exclusive right to induct a tenant. His permission was not taken and he is not getting any share in the rent. This is going on for more than five years. Can he evict the tenant on this ground? Thank you, Advocates.

your case, since the tenancy has been continuing for more than five years and rent is being accepted by some co-owners, eviction cannot be sought merely on the ground of lack of consent. The aggrieved co-owner’s proper remedy would be:To claim his proportionate share in the rent (by filing a suit for rendition of accounts and recovery of share of rent), and/orTo seek partition of the joint property.

two minors (14+ boy and girl) watch adult content together without any physical contact, generally POCSO offences relating to sexual assault do not apply because there is no sexual act or touch.However:Circulating, possessing, or sharing pornographic content involving children is an offence.If the content involves children (child pornography), then it is punishable.Mere viewing of adult pornography by minors may not directly attract POCSO sexual assault sections, but other IT Act provisions could apply depending on facts.
