Questions Answered by Advocate Pankaj Bajaj

Q: Interim Maintenance Arguments Strategy

If interested 125 crpc a x amount of ad interim maintenance is slapped based on primary facie facie salary level...and during the proceeding you had to change job with significant increase in salary but interim arguments is pending...before interim arguments should the husband will have to file a new affidavit because of change in circumstances or the arguments will happen on old affidavit only and it is not perjury not revealing with out any directions for it. Other party may or may not be knowing it...what is the right way to handle this situation.

Advocate Pankaj Bajaj answered
In Section 125 CrPC, transparency is vital. You must file an updated assets/liabilities affidavit citing change in circumstances. Concealing a salary hike risks perjury and invites adverse orders as per the concerned provisions of law.

Q: Chakbandi issue,Uttar pardesh.ORDER against deceased

1.Can a chakbandi officer order against deceased after widow mutation(vaad 147 against deceased) without mentioning the widow, the tenure holder, claming purnstaphna ,niyam 1092 Can he order gata move to third party khata with live different tenure holders from the beneficiary which chakbandi order creates citing jot aakar patr 453 Why R6/e parwana unimplemented even after a year .widow still the tenure holder .What causes it delay

Advocate Pankaj Bajaj answered
An order against a deceased person without impleading legal heirs (widow) is void. Transferring a Gata to a third party ignoring current tenure holders violates Consolidation Rules. Delays in R6/e parwana execution usually stem from pending appeals or revenue record discrepancies. File an application for execution before the SOC/DDC.

Q: execution order on maintenance arrear

I transferred X amount to wife's account after she filed 125 CrPC. Also I deposited Y ammount in the daughter's sukanya acc after the case was filed. As per law should not X+Y be deducted from the arrears? If yes, then do I object in the same court?

Advocate Pankaj Bajaj answered
Payments made after the filing of a Section 125 CrPC case can be adjusted against arrears. You should file a formal application for set-off in the same court with proof of these transactions as per the concerned provisions of law.

Q: How to Manage Two Lawyers in Divorce and Transfer Matters ??

I am from the wife’s side in a contested divorce matter. One lawyer is handling the main divorce case, and another lawyer was earlier consulted only for transfer/stay-related issues due to distance and safety concerns. Unfortunately, communication with the transfer lawyer broke down after a few dates. Now we are engaging a lawyer to handle the divorce proceedings properly, while we may still explore transfer/mediation if possible. My questions are:Is it advisable to clearly inform the divorce lawyer about the transfer attempt, or should the focus remain only on handling the main case until any order comes? How can fees be structured fairly (per hearing vs lump sum) so that the lawyer remains engaged even if transfer is later allowed? What is the best professional way to manage coordination without creating conflict or loss of interest from either side?Looking for practical guidance based on real court experience.

Advocate Pankaj Bajaj answered
Disclose the transfer attempt immediately for strategy alignment. Use a hybrid fee model: a base retainer plus per-hearing charges. This ensures the lawyer is paid for work done regardless of a future transfer. Clear communication avoids conflict.
