Yes, The Assistant Charity Commissioner can change the mode of succession of trustees.

Yes, Under Sec 50 A of Bombay Public Trusts Act, 1950, The Assistant Charity Commissioner can form a new scheme under which he has the powers to appoint & constitute a new Board of trustees for the first time.

Yes, you can challange this order of Assistant Charity Commissioner within Sixty Days from the date of such order passed by the Assistsnt Charity Commissioner.

The scheme framed under sub­section (1) or sub­section (2) or modified
under sub­section (3) of Sec 50 A of Bombay Public Trusts Act, 1950 shall, subject to the decision of the competent court under
section 72, shall take effect as a scheme settled or altered, as the case may be,
under a decree of a Court under section 50.
