Builder not giving compensation for delay

I booke a flat in Logix Zest Noida in Sep 2012, whose possession date was October 2014. When RERA came in existenace, the builder changed possession date to Nov 2018. Now on 4th may 2019, I received letter of possesion, I asked for delayed compensation but builder replies that "you are not eligible for penalty in your flat as you have not claimed for any penalty earlier." What does that exactly means ? Builder has received Occupancy/Completion Certificate What should I do ? Can I move to RERA ? Will I get compensation if move to RERA. What compnsation can I get ?

yes you can move rera for the compensation as the law of rera has retrospective effect and it has very little to do with the existence of the law of rera and the compensation will be determined as per the rate at which you have acquired the flat and the delay the builder has caused

yes certainly by moving to rera you might get mclr + 1% interest or whatever the interest was prescribed in your builder buyer agreement you will get that interest for delay in possession. you can approach up rera.
