Rental Agreement Registration for Leasehold Flat

14-Feb-2023 (In Property Law)
I own a DDA flat on leasehold (not yet converted to freehold). I want to rent this out. Can I register a rental agreement at the sub registrar's office? Or do I need to first convert to freehold before I can register the rental agreement.

Basically you are the owner of property in question although having leasehold rights in the same given to you by DDA. You can very well get rent agreement registered in your favour as you shall be owner qua tenant also. Conversion of same into freehold has different significance and implications. Read your lease deed also.

You are very well within your rights to rent out your leasehold DDA property to the person of your choice. Further you can get it registered if the lease is for a period of more than 1 year. There is no need of conversion. Freehold property has other significance.

In order to answer the your question it is important to examine the lease deed of your property. You may meet us with original lease deed so that we may provide you right legal advice.
