Procedure to remove joint ownership and register the flat in my name

Flat in Thane, Mumbai registered in my name and my mothers name, where as I had paid loan completely, now the mother is dead in 2010. I have a father and two younger sister, and I want whole flat on my name, I do have father and sisters NOC as well. How should I go ahead with the proceeding ,and what the documents I need.

Hi,
As I understand from your Query, your Mom had a share in the property being a joint owner. After her death, her share in the property is governed by laws of succession depending on your religion the appropriate laws will be applicable. You will also have a share in her share of the property alongwith your father and sister and other legal heirs, if any. This share of your mother can be bequeathed by your mother as per the will. If she has died without leaving a will, you need to take out letters of administration for the adminstration of the assets,shares,properties,if any of your mother appointing you as an administrator for which your father,sister and other legal heirs will give consent.
Once you get an order from the court appointing you as an administrator, your father sister and other legal heirs will have to execute their relinquish deed.

Hello, now it appears no body has any objection to transfer the same in your name so simply file an application before city survey office and municipal coronation along with the death certificate and said NOC and delete the name of your mother from records of right department.
