Prevent someone from getting a stay order on my construction site

17-Sep-2023 (In Property Law)
i had planning to build a new house,i have acquired the necessary building permission for the construction which states that i need to provide a fire gap of 10 ft from 2 sides and no fire gap on one side i e i can go blind(no fire gap on one side )on one side. However i suspect that if i go for blind from any side ,my neighbors will get a stay order on my construction which might result in suspension of my construction. Is there any legal way that i can follow to prevent them from getting a stay order???

You can file a caveat petition in the court having jurisdiction where the property is situated so that in case your neighbours file a suit and seek stay on construction, court will notify you. You may consult us for legal services.

Hi the process of filing a caveat before HC and trial court which means that whenever a case/suit/writ will be filed against you we will have information of that in advance .For further advisory/consultation i would request to call me or meet me in person at my office.

Definitely you can prevent them. If your neighbors get a stey order then At first you have to pass an vacate order against the stay order ,through your lawyer. Otherwise as usual you continue your construction. Thank u.

Hearing this loudly It is possible for a stay order to be removed from a property that is in dispute, by filing a request to cancel the order and proving all the requirements.
