Husband died. What rights do i have on his and ancestral property?

My husband died recently. He had one flat on his name. My in laws are alive and there is some parental property as well. What all are my rights in his property and HUF property?

Your husband was having two type of properties that is self acquired and Ancestral. First the Ancestral property shall be divided among all the coparceners by assuming that your husband is alive. Then his partitioned share of HUF + his self acquired property shall be devolve among his Mother, Wife, Sons and Daughters.

you have right in all property and in your husband property one part is yours and if any son n daughter than each have one one part and your in law's father n mother have one one part and in HUF you and your son n daughter have one one part each of you n if you not have any son n daughter than in Huf property u have one part of your husband

If your husband left any will you can apply in the court for issuing Probate certificate and if he died without left any Will you and your children are the owner of the Flat which is in his name & in this case you have to apply before the court for " Letter of Administration".
Now question arise for Parental Property. If parental property is purchased by in laws & belongs to him, made be themselves you have no right, but if parental property belongs to forefathers Dada,, Dadi, Nana, Nani or any other you have the right limited to yous husband's share. In this case you can file Partition Suit.
