Need to know procedure of transferring property ( cooperative society flat in Dwarka) from deceased husband to wife's name. Nomination already available with Society office. what is the cost involved in this proecedure.

to get the cooperative housing society flat transferred to your mother, the following steps have to be taken:

1. get an noc from all the legal heirs of the deceased husband that they have no objection to the flat being transferred to his wife;

2. if the society so requires, then a registered release deed and/ or succession certificate from the LRs of the deceased husband may also be required;

3. if the society accepts the above, then the transfer may be done. if not, then appropriate proceedigs may be filed depending on the facts and circumstances.

4. the fee involved differs from lawyer to lawyer, as per his/ her experience and standing at the bar.

first obtain surviving member certificate from local SDM. them submit same with cooperative society with the application to transfer share certificate in your favor. then ensure that you get in the list of society members ownership list.

According to Hindu Law, the wife can inherit her husband's property only if he died intestate. The Hindu Succession Act of 1956 describes the legal heirs to a male who dies intestate. A wife is listed as a Class I heir and inherits in equal measure with the other legal heirs.
