We have a property in Delhi region under my grandfathers name. He made a will Later on his death dispute had been started between our families so last year we decided to make a settlement deed however partition was done similar to will but we didn't executed the will. Now I have a question I am married and i don't want my share under my name and I want to evict my wife. So 1. how do my mother or my brother will obtain ownership title of this property 2. How do I relinquish my share so that they can evict my wife legally
First of all you need to share the family settlement of the family so that it can be ascertained how the property have been partitioned. The family settlement deed needs to be registered. Further you can relinquish your share in favor of any of your family member by executing relinquishment deed in their favor which also needs to be registered. The property needs to be transferred in the name of the person as per the partition/family settlement.
