How to get ownership of land if parents have died

Our Grandfather died many years ago, after that my grandmother also died. They did not register any deed/dalil of this land. Now my father wants to construct a house but they stopped our work saying plan should be passed. What should we do ??

Sir, after reading your question, I would advice you to register the house in your father’s name and get a sanctioned plan to construct your house on the land. It is illegal to construct a house without sanctioning a plan. Please call us if you want to know more.

you have to make a plan and pass it through your respective municipality/corporation. thereafter you can make the construction. but the requirement of deed/dalil might be important but that can only be answered after having a talk with you

As per your question , I take that your father is the only heir of your grandparents.
1. Make a 1st class judicial Magistrate Affidavit wherein mention the date of the deaths of your grand parents and Your father as the only legal heir. The affidavit have to be sign by your father not you.
2. Mutate your father's name in the Municipality/corporation.
3. Apply for the building plan.

If the property lies in the name of your grandfather and if he dies intestate (without making any will), the property automatically evolves in the name of your grandmother and father in equal portion. After the demise of your grandmother if she also did not make any transfer or will with respect to her share of the property, the property automatically to your father and he becomes the owner of the total property naturally. Now he has to mutate his name to the Municipality and to the BLLRO Office concerned and thereafter he will have to submit a proposed building plan to the Municipality/Panchayat concerned , and it will be passed accordingly, then only he can raise the construction legally.
