Gift of immovable property to my daughter

I have two daughters. I would like to gift my immovable property to my younger daughter. For getting the Gift Deed registered in Registrar office, the stamp duty payable would be at circle rate or above the circle rate if I want. Kindly confirmIs there any need of getting NOC from my elder daughter as I would be gifting her my second property in due course.

If the property being gifted is your self acquired property then there is no need to get NOC from your elder daughter. As far as your first question is concerned, the stamp duty is payable always at the circle rate only.

You need to hire an expert advocate in this regard. If the property is your self acquired than you can gift the property to anyone in the world !
Thr stamp duty for female would be around 4% of circle rate n 1% registration charges

Hello Sir.

This is Adv. Shrikant Samantara. 1) Stamp duty can be calculated at or above Circle Rate. 2) There is no requirement of stated NOC from Elder Daughter.

Further you may put some conditions in the Gift Deed itself, so that may remain financially protected in the coming years. Further “Will” is also a cost effective instrument for transfer of property of which you must be aware.

Yes there might be capital gain in such circumstances, however the same can be easily managed by the CA through property valuation. The entire facts in documenrt will have to be thrown into pool to look the actual effect

No there is no income tax implications on that particular gift and no need of any ITR .
Gift deed is dependable on circle rate of that particular area and only registered gift deed through SDM court is valid and you can easily gift your immovable property to your daughter as per the circle rate of your area .

You need to pay the stamp duty n registration charges as per the circle rates in this regard ! N for income tax etc you need to b in touch with CA you will assist you further ! Kindly b in touch to understand the legalities
