Clarification on HRA claim over property belonging to wife

Hi My wife owns a house which is gifted by his parents ,I don’t have any control on ownership of that house We are living in same house ,can I claim hra for the rent paying to wife ?

If the house is in the name of your wife and you are paying rent to her and further rent received by your wife is shown as an income in her income tax return then you can claim exemptions as per applicable law.

Hi, Under section 10 of Income tax Act, there are two requirements of the HRA claim, you should not own the house and your should be doing regular payments. If you do not have any governorship claim over the house, you can pay your wife a monthly rent amount in her account which shall be regular. You can not claim HRA without fulfilling this requirement.
