Can case be instituted against ex husband for not giving maintenance?

My ex husband says he is not working and cannot pay maintainance for the son. can i put a case against him in court. Can the court take action against him when not paying maintaince. MUSLIM RELIGION.

Dear Madam,

You can file a an application under section 125 of Criminal Procedure Code 1908 and seek maintenance from your husband. The court will verify the earning of your husband and accordingly award you maintenance .

Yes definitely you can approach to the court for your son and file a petition against your ex husband to maintain the son.
We can file a petition as per 125 CRPC in the concern family court and ask for maintenance

Yes you can ask for maintenance under guardians and wards Act for your son as you profess Islam as your religion. It also depends on your and your husband’s capacity to take care financially of your son.
