Want clarification on grounds to challenge motor accident compensation

02-Dec-2023 (In Motor Accident Law)
my friend took my bike without permission as i was not in city .he had an accident with a 15 yr boy riding cycle .both died .my bike was not insured. parents of boy who was on cycle filed case .lower court rejected their claim as they could not prove the boy died after 2 month because of accident and directed me to pay 20k only as medical expense which they spent before death. they again filed case in high court and now high court awarded rs 2 lakh compensation along with 8% interest .now can i go to lok adalat or what should i do to challenge this

Challenge the order of high court in the Supreme Court. With sufficient ground of you couldn't take insurance policy when you are out of town and proof it, your friend took ur bike without your permission.. Thanks

Lok Adalat is subordinate to high court, then how can you challenge it in. You can appeal against the order in double bench of high court, if decision was passed by single. But I would suggest you to stay by the same as in doing so the amount ordered by the single bench would surely increase, for which there would be numerous reasons as how key of your vehicle goes to your friend etc. Contact for further actions or advisory in regard.

No, a High Court order cannot be challenged in Lok Adalat. you may file a review petition in the same High Court within 30 days of the order. Additionally, you can appeal to the Supreme Court of India.

there are sufficient grounds to challenge the said order given by the high court, you can go either in double bench in high court or to supreme court, but to find out exact remedy in your case I need to see relevant documents, status of the both the deceased person, orders of the court....etc.
contact us as soon as possible as there may be limitation in challenging the order.....
