Met with an accident person died in hospital police took license
01-Jan-2023 (In Motor Accident Law)
I have met with an RTA, where I was driving the car with my family and suddenly a person comes to road ran towards the road to cross it and there was no crossing no red light. And unfortunately he hit with car and i stopped the car, and police officials came there and I asked them to take him to the hospital and one official asked for my license and gave him. Then they took my license and dropped the victim to the hospital. Next day he is dead and police officials asked me to submit the car and license and RC and i submitted and arrest memo signed and bail with my brother in law's license. And now i am worried for that IPC and case. Please guide
you will have to face the trial for causing death due to negligent driving and it will take considerably long time. however you can get bail during that period of trial. you will have to pay some money to the deceased family also if your vehicle is not insured. for better advice you need to visit my office.
Indeed an unfortunate incident. There is nothing to worry because you were holding a valid license. A duplicate copy of the license can always be obtained from the licensing authorities. A good lawyer can prepare the required defense in your case.
You will have to prove negligence on part of the man who died. Further the fact that he was crossing the road where there was no signal and no pedestrian crossing will help your case . For further assistance, please contact me.
U will hve to regular bail from court whn the police submit the challan of this case then in this case u will be charge with 279,304A of ipc. And u can take ur licence and also relative document of u and ur car by supperdari from the court at any time.
Hi,
Regarding your query. There are a few things that need to be taken into consideration.
1) Whether your car is insured and whether you have a valid license on the date of the accident.
2) Whether there were any eye witnesses investigated by the Police at the scene
3) Whether your car is registered in the state where the accident took place and whether your papers are in order
4) Was any CCTV footage obtained from the scene. ( This is important as it will decipher whether you broke the rules and crossed the red light or whether the man ran infront of you) . Your case can be defended. However, I would need more details for the same.
