Tenant Eviction in case of tenant presenting false rent agrrement

 my late father gave one a rent as tenant for 22 months. After his demise in 2014, when 22 months ended when we asked the tenant to vacant the premises, he showed another agreement made between father and him after 15 days of the signing the first agreement. The second agreement said of extension of 22 months period by another 10 months. It ended recently but on the last day of the end period he filed diary in local ps about he being threatened by our appointed antisocial which was absolutely lie. He took caveat from Lowe division court and asked for extension of tenancy agreement by filing another civil case. His payment of rent for all these period was fine. He also sent six months rent in advance directly into our bank account. I want to evict him. Please guide the legal way to evict him. Eagerly waiting for your guidance.

File a case against the occupant as a trespasser in the appropriate court of law and obtain a decree as if he has deposited the amount directly in the bank after the death of your father in that event as a legal heirs of the said property you have absolute right to remove him from the occupancy but only through courts directions as tendering of amount in a deceased person is not valid tender.

Look firstly I advice you to stay calm and be strong. Atfirst you sent a legal notice to quit from your lawyer. This notiçe is very important one. There must be a date , name of the tenant proper address , date of the expiry of tenancy, and schedule property. After lapse of 1month you can file a title suit for eviction and recovery of khas possession before the civil judge (junior/senior division). For further details you may take advice from a civil lawyer. Thanks a lot.
