Eviction of tenant on the ground of non payment of rent

We live in madurai , with oral agreement a tenant occupied our house and now for past 2 yrs no rent has been paid and the house is also locked , we have lodged a complaint in police station , police said we ll break the lock and keep tenant things in one room and we can use the house . We really dont kn how to vacant this tenant kindly guide us .

It is quite surprising you do not know your tenant's whereabouts, having let out your house. You have not stated whether you have any rental deposit with you and for how many months your tenant has defaulted on the rent. Police complaint may not be really helpful. You will be disturbed quite often, besides having to incur incidental expenses. Try to locate the tenant through his relatives or friends if known to you, and make an earnest attempt to arrive at an amicable settlement. If everything fails, file an eviction petition in the competent court, with an interim order for payment of rental arrears.

The best course of action is to file a suit for recovery of possession. But, since the tenant has absconded with the house locked, you may not be able to complete service of summons to him/her.

The police may not be able to help any further because this is a civil dispute.

If the tenant don't pay rent and occupy the premises amounts to wilfull default and on that ground he can be vacated by filing a petition in the rent controler court.you can't break open the lock and put your things, which will attract criminal action against you
