Eviction of old tenants and vacate

Our tenant has been living in our house since 40 yrs .In the starting years of tenency,they were giving rents and continued to give till 1987 but since they had not given a penny .because of the mutual understanding and the rental amount is minimal in today's time ,we did not object .tenants are hindu.Now we want to evict them and vacate our house ,what does the Law states in this matter.

I want to know the rent, if it is up to 3500 then you are governed by delhi rent control act. according to this act under section 14 you can vacate your premises on various grounds.

For recovery of possession of the tenanted premises, you can
A) either proceed by filing a petition before the Rent Controller under the Rent Control Act (if applicable) OR
B) you can promptly issue a notice for termination of tenancy and institue a civil suit for recovery of possession of the tenanted premises along with mesne profits and other incidental reliefs

you will have to file an application under DRC
before rent controller or in civil court depending upon rent of the property.
As you state it is minimal rent
I am sure it will fall under DRC.
Application will be filed before Rent Controller.
