What is the period to be eligible for gratuity?

Dear sir, I have completed 5 years and 4 months in an organisation and resigned. This tenure includes training period of 1 year. My date of joining was 07/06/12. My relieving date was 07/10/17. So this works out to one year of training and 4 years & 4 months of designated post of Project Engineer. During my relieving the employer didn't give gratuity. So can you help me to know if I am eligible for the training period also so the I will get gratuity paid for completing 5 years. Thanks & regards Arunkumar

As far as Trainee Period/Apprenticeship is concerned check with Apperenticeship Act that whether you were apperentice or not within the meaning of the Act, otherwise you will be treated as an employee and that period will also be counted

1. Gratuity is based upon the company procedures and policies. So accordingly only they will issue gratuity.
