Non receipt of Full & Final Settlements and Provident Fund.

09-Aug-2023 (In Labour & Service Law)
Dear Sir, I was working with a limited company for 5+ years (Jan 11 to May 16) . I resigned the company 3 months ago. I received the Relieving letter and Experience letter. Regarding FnF settlement, the HR told me that full and final settlement would be done according to company policy. But it's almost 3 months and no settlement has been done. They say full and final settlement of previous employees are still pending and they will be considered first. To every left employees, the dept gives same funny reason. Also, company has not deposited PF from October 2014. What is to be done?

We suggest that you send a legal notice through a lawyer thereby asking them to pay you full and final settlement or else you shall be contrained to take legal action. If they fail to respond then you can file suit for recovery

Dear sir
You have an absolute right to recover the pending payment pertaining to benefits which the company has not paid.
The company has to pay all statutory benefits upon the resignation/retirement of the employee and witholding the same is illegal.
