Legal remedy against PWD for compensatory appointment

my Father Was Driver in public ward department(pwd) indore last month he died due to illness. As my Father Died During The Service I Request Department To Allow me Compensatory Appointment But Department Denieid On The Basis That My Elder Brother Is Government Teacher In uttarpradesh Therefore No Family Member Allowed To be Appointed On Compensatory But My Brother Is Married And Lived Apart Since Last 7 Year And Also Not Provide Any Financial Assistance To mY Family . Is Their Any WAy To That Department Provide Compensatory Appointment to me
Though benefit of anukampa niyukti can be availed only to one person of the family and in case when there is no other means of income and family is completely depends upon salry of dead person.You have chance to apply for writ in high court of your state under article 226 as your brother is teacher under other state government and does not help in family requirement.
