Legal help if company filed lawsuit against me

14-Sep-2023 (In Labour & Service Law)
Dear Sir / Madam, I worked for a software company from 20th June 2017 to 15th June 2017. I served the legal 15 days notice period. But Company did not give my documents and salary . In between he wanted me to sign on document which will be stated as I will not work in the technology in which I was working in and I have to inform him about my new job. Couple of days before I sent him email stated as "Are there any chances that I can get my documents and salary and what about document to be given in written? ". In reply to my email he responded to me that "In response to your email sent yesterday, the company will be filing a lawsuit against you for reasons which will be spelled out in the suit. You may initiate proceedings yourself if you feel wronged and I will respond. Let the law take its course." Please tell me what should I do in this case. Thanks

Once you have served the company notice period as per the appointment letter , the company ought to relieve you.
You can redress your before civil court so also before the authorities under the Industrial Disputes Act. Redressal under Industrial dispute would be speedy. Recently the courts have decided that software engineers are also to be considered as workman under the Industrial Disputes Act unless you were working / performing work under supervisor cadre. Raising an industrial dispute would suffice your problem. You can also file application for recovery of wages before the Labour Court to recovery your salary.
