Left company in 6 days company asking to serve notice period

28-Jul-2023 (In Labour & Service Law)
i got a job offer with a company and i accepted the offer. however on joining i found the company very unprofessional and and i left the company after 6 days of joining after giving resignation through email. In my offer letter it is mentioned that i had to serve a notice period of 3 months or pay fixed salary in lieu of it. however all the condition of the offer letter were subjected to verification and finalization of my credentials which they failed to do till the day i left. Now the company is asking for compensation which is feel is not legitimate as they have not finalised the contract

If your job offers contains the clauses in respect to probation period then you can take the stance of that and can find a way out of this problem. If not, then if there is any clause which specifically states that your appointment confirmation is subject to your background verification and identity confirmation then you may use that too for your way out of this problem.
But if none of them are there specifically mentioned in your employment contract then either you have to serve the notice period or you have to pay the amount of not serving the notice period.

Dear Sir

Thank you for your query. I can understand the fix you are in. Was any employment agreement signed by you or only an offer letter? Did the offer letter clearly mention that your employment is subject to the verification process? I think we can help you by first drafting a strongly worded email asking them to stop harassing you followed by a complaint if the harassment continues. We will be happy to help you over a call or a face to face meeting. Please feel free to contact me.

Regards

Sanjeet
