If section 10(1) DSEAR 1973 is not complied with. what are the effects

As per section 10(1) DSEAR-1973,the scales of pay and allowances,medical facilities,pension,gratuity,provident fund and other prescribed benefits of the employees of any recognized private school shall not be less than those of the employees of the corresponding status in the school run by the appropriate authority. Which is substituted by The salary & allowances payable to, and the terms and conditions of service of employees of recognised private schools shall be such as may be prescribed. What willvb consequences?

If the law is changed the private schools will not have to abide by the mandate of Section 10 as it stands today but will comply with the new rules as May be made.
Today if section 10 is not complied with one can file a petition against the DOE AS WELL AS THE SCHOOL MANAGEMENT

In case of such discrepancy, the matter needs to be brought to the notice of the appropriate authority, who after considering the matter would direct the school to revise the scale of pay etc. If the school does not comply with such direction, it may result in de-recognition of the school.
