I am bound with employment agreement for not joining any competitor

07-Feb-2023 (In Labour & Service Law)

I was working in a Bangalore company.. As usual in appointment letter I signed in which it is written secrets about the company should not be disclosed to others. And recently I resigned.. In releiving and service later they have written that I should not join any competitor for next two years and also as per appointment letter I should not disclose confidential things to anybody.. Which will lead to legal action. But I want to join competitor.. And I have not signed any Non disclosure contract.. Or any employment bond... Pl. Advise

You are bound by the terms of the appointment letter as it forms a binding contract between you and your employer. The terms of a non-compete can be done away with only in certain circumstances. The non-disclosure however will be absolutely binding. One would have to study the exact language of the paperwork you have signed before forming a conclusive opinion.
