How to file FIR when police refuses to file it?

Hi I run a transport business in the state of maharashtra. I entered in a contract with individual and now he has run away without paying me rent and also ran away with my phone that I provided him. Police refused to register FIR saying that I gave him the phone and it is not robbery. Kindly help.

If in any case police refuse to file FIR then you have liberty to file private complaint in front of The competent court .
And also you have an right to file application under section 156(3) of criminal procedure code

Approach to higher police authority for the same with your application if the higher police authority is not helping you then you can approach your area magistrate's court through private complaint u/s 156(3) Cr. P. C.

YOU SHOULD APPROACH TO POLICE COMISSIONOR ABOUT THE SAME. OTHERWISE YOU SHOULD MADE PETITION IN THE MAGISTRATE OFFICE ALSO. COURT WILL PASSED ORDER TO POLICE STATION ABOUT FIR. SO YOU MAY SENT A NOTICE TO POLICE STATION.
