How can I recover my pending salary from my employer?

02-Dec-2023 (In Labour & Service Law)
Hi, I Have joined a company on 30th june for permanent position. I have got the first month salary. When salary payment time for second month came they said they have some problem in processing payment through bank which is taking time. That went on for one month. Then again for second month they said same thing.I had my responsibility which i could not able to fulfil,i denied working further and resigned. Now from more than one month they are saying you will get full settlement letter then you will get the payment. I said them why its taking so much of time for that letter. They are saying they have this process. They are simply delaying things by giving some nonesense reason. I want to get the legal Advice for getting my more than 2 months salary. Thanks.

Dear Client:

I am writing with regard to your query posted above. In the extant case, you may consider filing a complaint before labour officer under the labour laws.

If your employer is a company i.e. private limited, public limited or LLP and your total due salary or remuneration exceeds more that Rs. 1,00,000/- then, alternatively you may also consider filing an application before National Company Law Tribunal of appropriate bench in whose jurisdiction the registered office of your employer company is situated. If the registered office your company is in Karnataka then you can file the case of Corporate Insolvency Resolution Process before the National Company Law Tribunal, Bengaluru.

Trust the above clarifies your query.
