Gratuity not being issued by the company on resignation

I am working in a company from last 4 years and 9 months. Now I wish to move ahead. I asked my HR about gratuity. They told me I shall be eligible only if I have completed 240 WORKING DAYS in last 9 months, excluding leaves and weekend offs, which is impossible. Please advise if I am eligible for gratuity or not.

Payment of gratuity is applicable only after 5 year of service and in your case you have mentioned services of 4 year 9 Months only thus as per my opinion in your matter you are not entitled to claim gratuity from your employer
