Employment issues under section 47 of person with disability law 1995

My father is suffering from dementia From last 3 years or may be more. He is government employee in a uttar pradesh aided junior high school in aligarh district. Since November 2015 he is not able to do his job and so not going for that. Because he is not able to do his daily routine work and understand anything for live his life due to dementia. He got 65percent disability certificate in February 2016 and then from his side i applied for section 47 of disability law1995 for his basic shiksha adhikari and commissioner for person with disability lucknow . commissioner for disability ordered in our favour but not define that does my father get his salary while he is staying at home due to illness. By which his department refuse that that section doesn't not applicable on him or such job profile which false buf they not give any benefit and nothing force to take us VRS which is wrong. My father get no salary from January 2016. And whole family suffered alot. So plese give as true advice.

In the facts and circumstances as discussed by you it is very important to point out that it is very illegal act done by the government to stop the salary of your father suddenly. It may cause you great harm. You can challenge their act by way of Civil Misc. Writ Petition before concerned High Court. You may also move a representation to the concerned department to get you appointed on the basis of compassionate appointment.
