What can I do? If I go legally , Can I win the case? Hi I had 3 years of bond in my previous company and I have gracefully exited with all the proper documentation and with manager’s acceptance(with proper resignation acceptance letter from company) serving 2 years 5 days. I exited company on August 13th 2018. I did not receive salary of July 2018 as well as for August. Now when I asked for my full and final settlement for my previous company, they are threatening me that they would not release my full and final settlements and final pay slips as I had 3 years of bond. And also they mentioned that they will not cooperate for the BGV process from my future employer. They are asking me to pay the bond brakeage charges now Now my future employment is at risk because of this issue. What can I do? If I go legally , Can I win the case?

Hi as you have executed a bond/undertaking with your previous company and since the requisite term is not completed you have committed a breach of contract/undertaking. However it is very much important to understand your roles and responsibilities in the previous organization and the skills and competencies that you developed during the stay in that organization and also the support provided by the organization in terms of training and coaching. Based on all these facts the case can be dealt with legally if you are ready to file a suit against your previous employer. Consult me for any help at required in this regard.
