Employer not reliving the salary until new employee doesn't join

06-Aug-2023 (In Labour & Service Law)
Hi I have been employed for 2 months back and have recently resigned. I am on probation and serving notice period and have served one month notice also. The agreement states notice of 2 months . Due to resignation my superior is not releasing salary and is afraid that if salary is released i will move away and asking till new employee doesn't join we can't relieve although I have handed over all my work to the person. Due to non receipt of salary my monthly committments got failed. What should I do please guide.

This is my response to you:
1. You should send a formal complaint to the HR department;
2. If they do not resolve then send a legal notice to HR and your employer;
3. You can also seek compensation for the mental and monetary loss suffered by you.

As per your query
You recently resigned and your superior nor reliving you and not releasing payment. In this situation you can make representations in writing to your superior if no positive reply you can send legal notice through Advocate.
